Personal Data Protection (KVKK) Notice

Privacy notice under the Turkish Personal Data Protection Law No. 6698.

This notice has been prepared by Fayntech, acting as data controller, pursuant to Article 10 of the Turkish Personal Data Protection Law No. 6698 ("KVKK") and the Communiqué on the Principles and Procedures to Be Followed in Fulfilment of the Obligation to Inform.

1. Identity of the Data Controller

Your personal data is processed by Fayntech, established in Izmir, in its capacity as data controller, within the scope described below.

2. Categories of Personal Data Processed

The following categories of personal data are processed through the contact form and the job application form on our website, or within the scope of the technical operation of the site:

  • Identity Data: First name, last name.
  • Contact Data: E-mail address, telephone number.
  • Resume (Professional Experience) Data: The CV file you submit with a job application and the information it contains.
  • Transaction Security Data: IP address, session records and technical logs strictly necessary for the secure operation of the site.

3. Purposes of Processing

Your personal data is processed exclusively for the following purposes:

  • Responding to and following up on requests, suggestions and complaints submitted through the contact form,
  • Receiving and evaluating job applications and conducting recruitment processes,
  • Ensuring the security of the website and the services provided, and preventing unauthorised access,
  • Fulfilling legal obligations arising from applicable legislation and responding to requests from competent authorities.

4. Legal Grounds for Processing

Your personal data is processed on the following legal grounds set out in Article 5 of the KVKK:

  • Art. 5/2-c KVKK: Processing being necessary for the establishment or performance of a contract, provided that it is directly related to the parties of the contract (e.g. job application processes, preparing an offer upon request),
  • Art. 5/2-ç KVKK: Processing being mandatory for the data controller to fulfil its legal obligations,
  • Art. 5/2-f KVKK: Processing being necessary for the legitimate interests of the data controller, provided that the fundamental rights and freedoms of the data subject are not harmed (e.g. ensuring service security, responding to contact requests),
  • Explicit consent (Art. 5/1 KVKK): In cases falling outside the above legal grounds, processing takes place only where you have given your explicit consent.

5. Transfer of Personal Data

Your personal data is not shared with third parties unless there is a legal obligation to do so. Your data may only be transferred to:

  • Legally authorised public institutions and organisations, in order to respond to their lawful requests,
  • The hosting service provider of the website, to the extent necessary for the technical provision of the service.

Your personal data is not transferred abroad.

6. Retention Periods

  • Contact form records: For a maximum of 2 years from the date of submission,
  • Job application records and CVs: For a maximum of 1 year from the date of application,
  • Transaction security records: For the periods prescribed by the applicable legislation.

At the end of these periods, your data is deleted, destroyed or anonymised. Longer retention periods required by law, as well as statutory limitation periods, are reserved.

7. Your Rights Under Article 11 of the KVKK

Pursuant to Article 11 of the KVKK, as a data subject you have the right to:

  • Learn whether your personal data is being processed,
  • Request information if your personal data has been processed,
  • Learn the purpose of the processing and whether your data is used in accordance with that purpose,
  • Know the third parties to whom your personal data is transferred, in Türkiye or abroad,
  • Request the correction of your personal data if it is incomplete or inaccurate,
  • Request the deletion or destruction of your personal data under the conditions set out in Article 7 of the KVKK,
  • Request that corrections, deletions and destructions be notified to the third parties to whom your personal data has been transferred,
  • Object to a result arising to your detriment from the analysis of your processed data exclusively by automated systems,
  • Claim compensation for damages incurred due to the unlawful processing of your personal data.

8. How to Apply

You may submit your requests regarding the rights listed above to furkan@fayntech.tr, together with information and documents establishing your identity, in accordance with the Communiqué on the Principles and Procedures for Applications to the Data Controller. Your application must include your name, surname, the subject of your request and your contact details.

Applications are concluded free of charge as soon as possible and within 30 (thirty) days at the latest, depending on the nature of the request. If the process requires an additional cost, the fee determined by the Personal Data Protection Board may be charged.
